Terms of use of the Wörthersee Plus Card

General Terms and Conditions

These general terms and conditions apply to all categories of the Wörthersee Plus Card.

1. benefits: With the purchase of the Wörthersee Plus Card, the respective guest acquires, depending on the card category and in accordance with the present General Terms and Conditions, entitlement to the services presented in the brochure. These are either inclusive services of the Wörthersee Plus Card inclusive partners or bonus services of the Wörthersee Plus Card bonus partners. Inclusive services include the use of the respective service offered, which is already compensated for by the purchase of the Wörthersee Plus Card. Bonus services only include the entitlement to a reduction of at least 10% on the fee to be paid for the respective service used. In addition to the respective card category, the non-binding content of the Wörthersee Plus Card brochure shall always be decisive for the scope and type of the service to be claimed.

2. scope of service/liability: All partner businesses are obligated to provide Cardholders with the full scope of their services designated as Wörthersee Plus Card services in terms of time and quantity during the promotional period during their normal business hours and in accordance with their general terms and conditions of carriage and business. The service of an inclusive operation can be used max. 1 time per day during the action period. Bonus partners are subject to a best price guarantee and must grant cardholders the same or better conditions than all other individual customers. Restrictions on the use of Wörthersee Plus Card services may generally result from the operating hours of individual partner businesses, which may not cover the entire promotional period of the Wörthersee Plus Card, primarily due to weather and seasonal circumstances. The non-binding opening hours stated in the Wörthersee Plus Card brochure as well as any information provided by the partner establishments themselves (e.g. their homepage, etc.) must therefore be observed. The Region Wörthersee-Rosental Tourismus GmbH also reserves the right to terminate the agreements with individual inclusive partners and bonus partners for important reasons at any time, even during the promotional period, without having to compensate the cardholder for the resulting loss of the opportunity to use the services offered. The Region Wörthersee-Rosental Tourismus GmbH and its cooperation partners do not assume any liability whatsoever for any damages suffered by a Cardholder in connection with the use of offered services. When using the services of the Wörthersee Plus Card, the Cardholder becomes a contractual partner of the respective partner business, so that all resulting claims are to be asserted exclusively against the latter.

3 Toll Roads/Navigation Lines/Mountain Railways: On toll roads, each vehicle occupant (motorcycle, car or bus occupant) must have a valid card. Otherwise, a proportional road toll will be charged. The offer of the shipping lines refers to the scheduled trip according to the timetable, but not to special events and special services. The Wörthersee Plus Card is a leisure card and not a sports card. The offer of the mountain railroads therefore does not refer to multiple daily repeat travel for sporting purposes (e.g. paragliding, tobogganing, cycling, etc.).

4. issue requirements: The Wörthersee Plus Card is issued free of charge by certain lodging establishments for the duration of the tourist's stay and cannot be purchased.

5. validity requirements: The Wörthersee Plus Card is not transferable and is only valid in conjunction with an official photo ID. Consequently, the services associated with the Wörthersee Plus Card can only be used by the person named on the card within the period of validity of the Wörthersee Plus Card (promotional period). The promotional period during which the benefits associated with the Wörthersee Plus Card may be claimed is specified in the Wörthersee Plus Card brochure, which is published annually. The validity period of each individual Wörthersee Plus Card depends on the respective service package purchased. The Wörthersee Plus Card and its service packages are only valid in the calendar year of their purchase. There shall be no reimbursement for cards and service packages unused or only partially used in a calendar year.

6. Use: In order to use the services associated with the Wörthersee Plus Card, the Cardholder shall present his/her Wörthersee Plus Card to the respective partner establishment, which shall check it for validity. The Cardholder is obligated to present an official photo ID upon request. If he/she is unable to do so, the services of the Wörthersee Plus Card may be refused.

7 Misuse: In the event of misuse or mere suspicion of misuse, the individual partner businesses are entitled and obligated to withhold the card without compensation. Passing on the Wörthersee Plus Card to third parties is not permitted and will result in criminal consequences!

8. children's reductions: The age group-related reductions are based on birth cohorts, which are listed in the Wörthersee Plus Card brochure for the respective calendar year.

9. use of personal data: By purchasing a Wörthersee Plus Card, the Cardholder expressly agrees that his/her master data (name, date of birth, postal and e-mail address and telephone number) may be used by Region Wörthersee-Rosental Tourismus GmbH for advertising purposes. The Cardholder further agrees to receive information from the cooperation partner by telephone, fax, e-mail and SMS, also for advertising purposes. The Cardholder has the right to revoke his/her consent to the use of data in writing at any time.

10. theft/loss: In the event of theft or loss of the Wörthersee Plus Card, the Cardholder may report this incident to any issuing office. The Region Wörthersee-Rosental Tourismus GmbH assumes no liability in case of theft or loss.

11 Applicable law/place of jurisdiction: All legal relationships between Region Wörthersee-Rosental Tourismus GmbH and the Cardholder shall be governed exclusively by Austrian law with the exception of the UN Convention on Contracts for the International Sale of Goods (UNCITRAL) and the reference norms of the conflict of laws (IPRG). For all legal disputes arising from or in connection with the legal relationships between Region Wörthersee-Rosental Tourismus GmbH and the Cardholder, it is agreed that the court with subject-matter jurisdiction for Villach, Austria, shall have jurisdiction.
